Bacon Stands by Constitution, Votes Against Gun Bill

Washington, D.C. – Following the House vote on S. 2938 Senate Gun Control Act, Rep Don Bacon (NE-02) issued the following statement on why he voted to uphold the Constitution:

“My vote today was constitutionally based, not politically based. There was much in this bill that is commendable, but the Red Flag portion opens up consequences I cannot support. This week’s earlier Supreme Court decision on the Second Amendment indicated the court may find red flag laws unconstitutional and the Ninth Circuit Court’s decision last May found California’s age restrictions on gun purchases unconstitutional.

"In addition, I do not believe federal tax dollars paid for by Nebraskans should be used in other states, such as California and New York, to fund Red Flag programs that do not have due process protections nor a right to attorney. Finally, The Red Flag portion diverts grant money away from hiring, training, and equipping law enforcement personnel while putting further responsibilities on their shoulders. I do fully support the mental health and school security provisions.”
