Washington, D.C. – Rep. Don Bacon (NE-02) voted today to protect infants who are born alive after an abortion procedure. H.R. 26 – Born Alive Abortion Survivors Protection Act would also provide an avenue for the mother to hold the abortion provider accountable.

“I have met two grown women who survived attempted abortions, both having scars caused by the abortionists. It would have been utterly tragic if these two, using the words of a previous Governor of Virginia, were ‘kept comfortable’ until they died from lack of care. While the number is low for late-term abortions to result in live births, it does happen and to allow abortion providers to kill the living baby after it has been birthed is barbaric and immoral,” said Bacon. “Abortion providers should be required to provide life-saving actions when the abortion procedure fails, and mothers need the reassurance to know they will not be held responsible.”

Under this legislation, the mother of a child born alive could not be prosecuted. It also would provide for civil remedies for mothers of children who are born alive as a result of a failed abortion.
